Ohio Unemployment Fraud
What ODJFS Considers Fraud
Under ORC 4141.35, unemployment fraud in Ohio means making a fraudulent misrepresentation to obtain benefits you're not entitled to. Common examples:
- Reporting that you did no work during a week when you actually worked and earned wages
- Disguising a voluntary quit as a layoff
- Fabricating or padding work search logs with contacts you never made
- Concealing income from part-time, temporary, or self-employment
- Altering separation dates or misrepresenting why you left a job
- Filing claims under someone else's identity
Honest mistakes happen — misunderstanding what counts as gross earnings, or accidentally entering the wrong week for a start date. The distinction matters because ODJFS treats intent differently. A genuine error corrected promptly isn't automatically fraud.
The Penalties for Fraud
If ODJFS determines you committed fraud, the consequences under ORC 4141.35(A) are steep:
- Full repayment of every dollar of benefits you received but weren't entitled to
- 25% penalty on top of the canceled benefit amount
- Benefit ineligibility — for each application or weekly claim canceled for fraud, you are ineligible for two otherwise valid weekly claims made within six years after the fraud is discovered
- Federal tax refund offset — TOP may offset federal tax refunds to collect delinquent state UI debt involving fraud or failure to report earnings; the agency must notify you at least 60 days before referring the debt to TOP
These penalties stack. A claimant whose 10 fraudulent weekly claims are canceled doesn't just repay those benefits — they also owe the 25% surcharge and are ineligible for 20 otherwise valid weekly claims claimed within six years after discovery.
Non-Fraud Overpayments Are Different
Not every overpayment is fraud. Non-fraud overpayments under ORC 4141.35(B) happen when benefits are paid in error — an employer's late wage report changes your eligibility, an appeal reversal makes previously paid weeks unentitled, or an administrative calculation mistake credits too much.
For non-fraud overpayments, ODJFS cancels the unentitled credit and orders repayment or withholds from future benefits. There's no 25% penalty and no extra weeks of benefit ineligibility.
ODJFS has stated that its overpayment waiver program is no longer available. If you disagree with an overpayment determination, your recourse is to appeal within 21 days of the mailing date.

How Fraud Investigations Work
ODJFS investigates when patterns appear: inconsistent earnings reports, employer protests contradicting claimant filings, identity flags, or anonymous tips. The agency may compare your reported earnings against employer payroll records, cross-reference state and federal databases, and audit your work search logs.
If flagged, you'll receive a notice asking you to respond. Answer honestly and provide documentation. Ignoring fraud correspondence accelerates the adverse determination.
What to Do If You Made a Mistake
If you realize you reported something incorrectly — wrong earnings figure, missed a week of part-time work, or misunderstood a question — contact ODJFS to correct the record as soon as possible. Self-correction before an investigation starts demonstrates good faith, which matters when ODJFS decides whether an error is fraud or an honest mistake.
Never try to fix a mistake by filing false information in the opposite direction. Two wrong answers are worse than one.
