Texas Unemployment Work Search Exemption: Who Qualifies and How It Works

The Default Rule: Work Search Required

Unless TWC tells you that you are exempt, Texas requires unemployment claimants to complete a minimum number of work search activities each week. The exact number is set by the Local Workforce Development Board for the county where you live, so it varies across the state. Unless exempt, you must also register on WorkInTexas.com within three business days of filing your initial claim.

But not every claimant is held to this requirement. TWC recognizes specific situations where the standard weekly job search does not apply.

Who Qualifies for an Exemption

Temporary layoff with a recall date. If you remain attached to a job and have a definite return-to-work date within eight weeks of your initial claim, you may be exempt from weekly work search requirements. A return date within 12 weeks may qualify if your employer verifies the date. A verbal promise alone does not establish the definite return date TWC requires.

Union members who obtain work only through a union. TWC may exempt a union member whose work is secured only through a union from the regular work search requirement.

Approved training program participants. Claimants attending TWC-approved or Trade Adjustment Assistance (TAA) training may be exempt from the regular work search requirement. Enrolling in a community college course on your own does not automatically qualify.

What an Exemption Does and Does Not Cover

An exemption removes the weekly work search activity requirement. It does not remove the requirement to file biweekly payment requests. You must still certify every two weeks, answer the eligibility questions honestly, and report any earnings from work performed during each claim week.

If you are exempt from work-search requirements, TWC says you do not need to register as a job seeker. Follow the instructions in your TWC notice about any registration steps that still apply to your claim.

If your exemption expires — your recall date passes without being called back, your training program ends, or your union referral lapses — the work search requirement reactivates immediately for the next claim week. There is no grace period.

How to Know If You Have an Exemption

TWC does not always communicate exemptions clearly. If you believe you qualify:

  1. Check your claim details in Unemployment Benefit Services (UBS). Any active exemption should be reflected in your account.
  2. If you are on temporary layoff, confirm with your employer that they submitted the recall information to TWC.
  3. For training exemptions, verify that your specific program was approved by TWC — your training provider or local Workforce Solutions center can confirm.

When certifying during your biweekly payment request, the system still asks about work search activities. If you have a documented exemption, answer based on your exemption status. If you are unsure whether your exemption is active, call the Tele-Center at 800-939-6631 and confirm before filing.

Filing a payment request claiming you completed work search activities when you did not — even if you believe you are exempt — creates problems if the exemption was never formally applied to your claim.

Exemptions Do Not Last Forever

Temporary layoff exemptions have a built-in clock. If your employer does not call you back by the recall date (or extended date), your claim converts to a standard claim with full work search requirements. At that point, you must begin conducting and logging weekly job search activities immediately.

The Filing for Unemployment in Texas guide includes a work search log and a biweekly certification walkthrough that covers both standard and exempted filing scenarios, so you know exactly what to report regardless of your situation.
