How to Submit Exhibits for a CUIAB Unemployment Appeal Hearing

Why Your Exhibit Packet Matters

The ALJ hearing is where evidence normally enters the administrative record. The CUIAB Appeals Board reviews the case record and may consider additional evidence only for good cause. You can request to submit more by attaching it to your Board Appeal and explaining why it was not presented at the hearing and why it matters.

For self-represented claimants, the exhibit packet is often the difference between a well-organized case and a disjointed one. ALJs manage dense hearing calendars, and in most cases 45 minutes to one hour is allotted for the hearing. A clearly indexed set of documents lets the judge find and reference specific evidence quickly.

What to Include in Your Exhibits

The specific documents depend on your case type, but common exhibits for California unemployment appeals include:

For misconduct discharge appeals:

  • Written workplace policies or employee handbook sections the employer claims you violated
  • Any written warnings in your personnel file — or a statement noting their absence
  • Emails, texts, or internal messages related to the incident
  • Performance reviews showing satisfactory or positive evaluations before the termination
  • Names and contact information for witnesses

For voluntary quit appeals:

  • Written complaints or reports you submitted to management before resigning
  • Medical documentation if a health condition contributed to your decision
  • Pay stubs showing reduced hours or wages
  • Records of unsafe conditions (photos, incident reports, OSHA complaints)

For overpayment appeals:

  • Pay stubs and bank statements for the weeks in question
  • Employer work schedules showing actual hours worked
  • Correspondence with the EDD about reported earnings
  • Evidence of any EDD error in calculating the overpayment

How and When to Submit

Your Notice of Hearing specifies the exhibit submission deadline and instructions. The exhibit cutoff is typically set before the hearing date — submitting on the day of the hearing risks exclusion.

There are several submission channels:

Through the myAppeal portal. If you have an active CUIAB myAppeal account, you can upload documents electronically. This is the fastest method and displays a green notification when the upload succeeds.

By mail. Send copies (never originals) to the CUIAB Office of Appeals handling your case. Contact the Office listed on your Notice of Hearing to confirm the submission instructions and address. Use certified mail or a tracking service so you have proof of delivery.

By fax. If a fax number is provided on your hearing notice, you can fax exhibits. Retain the transmission confirmation showing date, time, and page count.

Follow the document deadline listed on your Notice of Hearing. Documents uploaded to myAppeal do not appear immediately; they become available to all parties after CUIAB staff review.

Organizing Your Packet

Number each exhibit sequentially (Exhibit 1, Exhibit 2, etc.) and create a simple cover sheet listing:

  • Exhibit number
  • Brief description ("Exhibit 3 — Email from supervisor dated March 12, 2026")
  • Number of pages

During the hearing, when you want the ALJ to look at a specific document, you can say "Please refer to Exhibit 3, page 2" instead of trying to describe the document from memory. This is especially important in telephone hearings where the judge cannot see your gestures or follow your gaze.

Privacy and Redaction

Redact sensitive personal information from exhibits before submission. Remove full Social Security Numbers (last four digits are sufficient for identification), bank account numbers, and private medical details that are not directly relevant to the case.

CUIAB hearings are open to public observation unless the ALJ closes them or issues a protective order. Information the agency obtains in administering the program is confidential and not open to the public, but a party waives confidentiality in that information after it is presented at a public hearing on the merits.

What Happens if You Miss the Deadline

If you discover a critical document after the exhibit deadline, contact the CUIAB Office of Appeals immediately and explain the situation. Under 22 CCR § 5062(j), the ALJ may exclude an untimely exhibit.

Do not assume late evidence will be accepted. The safest approach is to gather and submit everything before the deadline, even if some documents seem only marginally relevant. Having an exhibit in the record and not needing it is far better than needing it and not having submitted it.

The California Unemployment Appeal Guide includes an exhibit cover sheet template and an evidence organization worksheet to help you build your packet methodically.
